Terms and Conditions for Scrub Club Ltd - A Subscription-Based Mobile Car Wash Business

These terms and conditions ("Agreement") govern your subscription and use of the mobile car wash services provided by Scrub Club Ltd ("Company"). By subscribing to and using our services, you agree to be bound by the terms and conditions outlined below. If you do not agree with any part of these terms and conditions, you may not subscribe to or use our services.

  1. Subscription Services: a. Our subscription-based mobile car wash service provides you with regular car washes as per the subscription plan you select. b. You agree to provide accurate and up-to-date information during the subscription process. c. The subscription is non-transferable, and you may not assign or share it with any other individual or entity.

  2. Service Availability: a. Our mobile car wash services are available within the designated service areas as determined by the Company. b. We strive to provide the service on the scheduled date and time, but we do not guarantee that the service will be available at all times or without interruptions. c. In case of unforeseen circumstances or events beyond our control, we may reschedule or cancel the service and notify you in advance.

  3. Subscription Fees and Payments: a. You agree to pay the subscription fees associated with the selected plan. The fees are outlined during the subscription process and are subject to change with prior notice. b. Payment for the subscription is due in advance, either every one, two or four weeks, depending on the chosen plan. c. Payments are to be made through the designated payment methods accepted by the Company. d. Failure to make timely payments may result in suspension or termination of your subscription.

  4. Cancellation and Refunds: a. You may cancel your subscription at any time after your second wash (completed visit) by providing written notice to the Company or using the cancellation method provided on our platform. Cancellation requests submitted before your second wash has been completed will not be accepted and you remain bound by these terms until that condition is met. b. Refunds are generally not provided for partial subscription periods or unused services. However, in exceptional cases, refunds may be considered at the sole discretion of the Company. c. If you cancel your subscription, you will be responsible for any outstanding payments due up until the cancellation date and will lose any credits accrued. d. You will be liable for our standard service fee if you cancel or reschedule a visit without more than 24 hours notice. e. Multiple Accounts: Any individual who creates or uses multiple accounts in an attempt to circumvent the minimum two-wash commitment or otherwise exploit our platform will remain subject to the two-wash minimum requirement per membership, regardless of the account used. The Company reserves the right to merge, suspend, or terminate accounts where abuse is identified, and any outstanding obligations under this clause will remain enforceable.

  5. Responsibilities and Liability: a. You are responsible for ensuring the availability and accessibility of your vehicle during the scheduled service time. b. You agree to provide accurate information regarding the location, parking, and access to your vehicle. c. While we take precautions to ensure the safety and security of your vehicle during the service, you acknowledge that you are solely responsible for any personal belongings left in the vehicle during the service. d. Vehicle Damage: All services are carried out entirely at the customer's risk. The Company does not accept any responsibility or liability for any damage to your vehicle, howsoever arising, during or as a result of the service. By subscribing to and booking a wash, you explicitly accept and acknowledge this limitation of liability. In particular, because vehicles are often presented for cleaning in a dirty or unwashed state, pre-existing damage, scratches, or defects may not be visible prior to the first wash. The Company therefore cannot be held responsible for any damage that may have already been present before the service was carried out. If you wish to make a damage claim, you must provide clear photographic evidence showing the condition of your vehicle taken on a date no less than one (1) day before your first scheduled wash date. Claims submitted without such evidence, or where the evidence does not conclusively demonstrate that the damage did not pre-exist the wash, will not be considered. The Company's decision regarding any damage claim shall be final. e. The Company shall not be liable for any damage, loss, or theft of personal belongings or any other indirect or consequential loss arising from the service.

  6. Changes to Terms and Conditions: a. The Company reserves the right to modify or update these terms and conditions at any time without prior notice. b. Continued use of our services after any modifications to the terms and conditions constitutes your acceptance of the revised terms.

  7. Governing Law and Jurisdiction: a. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. b. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts in [Jurisdiction].
